PLEASE READ THESE CONDITIONS CAREFULLY
These Terms and Conditions (“Conditions”) govern the provision of digital advertising
services by us to you. By using our services, you agree to be bound by these
Conditions.
We may update these Conditions from time to time. You should review them
regularly to ensure you understand the terms that apply at the time you use our
Platform.
In these Conditions, “we”, “us” or “our” means Key2Car Ltd. When we refer to
“Key2Car”, this includes the website located at https://key2car.co.uk (the “Platform”)
and any associated mobile or digital services operated by us.
These Conditions apply to any advert that is placed, renewed and/or amended until
that advert expires, is removed, or is renewed.
- OUR CONTRACT WITH YOU
1.1 These Conditions apply to any advert for the sale of a vehicle placed on Key2Car
by a private seller or a dealership.
1.2 By placing an advert with us, you are deemed to have accepted these Conditions
in full.
1.3 Each time we accept a request from you to place an advert, a separate contract
is formed between you and us, subject to these Conditions.
1.4 No contract shall exist until we have accepted your advert and made it live on the
Platform. - PLACING AN ADVERT
2.1 When you place an advert, you may be required to create an account with a
username and password. You are responsible for maintaining the confidentiality of
your login details.
2.2 You agree that all information provided during registration and advert creation is
accurate, complete, and up to date.
2.3 We reserve the right to reject any advert at our discretion. Where possible, we
will notify you of the reason for rejection.
2.4 Once your advert is accepted, we aim (but do not guarantee) to publish it within a
reasonable timeframe.
2.5 Adverts may appear across all Key2Car platforms, including desktop, mobile,
and any third-party partner platforms or marketing channels.
2.6 Upon publication, you may receive confirmation of your advert going live.
2.7 We may assign a unique reference number to your advert for identification
purposes.
- ADVERTISING PACKAGES
3.1 Key2Car offers advertising packages to both private sellers and motor
dealerships.
3.2 Dealerships may subscribe to one of several tiered packages, which may include
features such as increased listing capacity, enhanced visibility, and promotional
tools.
3.3 Private sellers may purchase individual advert listings or packages as made
available on the Platform.
3.4 The duration of adverts will depend on the package selected and may be subject
to renewal or expiry.
3.5 We may offer optional promotional features (such as “featured listings” or
“boosts”) which enhance the visibility of adverts.
3.6 We do not guarantee that any advertising package or feature will result in a sale
or a specific level of enquiries. - ADVERT CONTENT GUIDELINES
4.1 Each advert must relate to a single vehicle only.
4.2 You may not list multiple vehicles within a single advert.
4.3 All content submitted as part of an advert (including text, images, and videos)
must:
(a) accurately describe the vehicle;
(b) comply with all applicable laws and regulations;
(c) not be misleading, false, or deceptive;
(d) not infringe any third-party rights;
(e) not contain offensive, abusive, defamatory, or unlawful material;
(f) not include spam, irrelevant content, or unrelated advertising;
(g) not include personal data of third parties without consent;
(h) not promote illegal activity or fraud.
4.4 You are solely responsible for the content of your advert.
4.5 We reserve the right to remove or amend any advert that breaches these
Conditions.
- USER WARRANTIES
5.1 By placing an advert, you warrant that:
(a) you have the legal right to sell the vehicle;
(b) the vehicle is accurately described;
(c) the mileage and price are correct;
(d) the vehicle is not stolen or unlawfully obtained;
(e) you are not misrepresenting your identity;
(f) you will act honestly and in good faith in any transaction.
5.2 If you are acting in the course of a business, you must identify yourself as a
trader and comply with all applicable consumer protection laws. - OUR RIGHTS AND OBLIGATIONS
6.1 We will provide our services with reasonable care and skill.
6.2 We do not guarantee uninterrupted or error-free access to the Platform.
6.3 We may carry out maintenance and updates from time to time.
6.4 We reserve the right to:
(a) refuse, edit, or remove any advert;
(b) suspend or terminate accounts;
(c) modify the Platform or its functionality.
6.5 We are not responsible for the content of adverts, which remains your
responsibility. - CHARGES AND PAYMENT
7.1 All fees are displayed on the Platform.
7.2 Payment must be made in advance of publication.
7.3 All payments are non-refundable except where required by law or expressly
stated otherwise.
7.4 We may change pricing at any time, but changes will not affect adverts already
purchased.
- TERMINATION
8.1 We may suspend or terminate your account or remove adverts where:
(a) you breach these Conditions;
(b) we suspect fraudulent activity;
(c) you fail to make payment;
(d) you misuse the Platform.
8.2 Where we terminate due to breach, no refund will be provided. - YOUR RIGHT TO CANCEL
9.1 By submitting an advert for publication, you request immediate performance of
our digital advertising service.
9.2 Once your advert is live, you lose your statutory right to cancel and will not be
entitled to a refund.
9.3 You may remove your advert at any time, but no refund will be issued. - LIABILITY
10.1 Nothing in these Conditions excludes liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation.
10.2 We are not liable for:
(a) loss arising from reliance on adverts;
(b) disputes between buyers and sellers;
(c) loss of profits, business, or opportunity;
(d) failure to sell a vehicle.
10.3 Our role is limited to providing an advertising platform only. - DATA PROTECTION AND SECURITY
11.1 By placing an advert, you consent to your information being published on the
internet and accessible globally.
11.2 We may use tools to protect your contact details (such as messaging systems
or number masking).
11.3 Personal data is processed in accordance with our Privacy Policy.
- INTELLECTUAL PROPERTY
12.1 You grant us a non-exclusive, worldwide licence to use, display, and promote
your advert content.
12.2 All rights in the Platform belong to Key2Car Ltd. - GENERAL
13.1 We may transfer our rights and obligations under these Conditions.
13.2 If any provision is found to be invalid, the remaining provisions remain in effect.
13.3 Failure to enforce any provision does not constitute a waiver.
13.4 These Conditions are governed by the laws of England and Wales.
13.5 The courts of England and Wales shall have jurisdiction over any disputes. - TRADE AND PRIVATE SELLERS
14.1 These Conditions apply to both private sellers and dealerships unless stated
otherwise.
14.2 If you are a trader, you must clearly identify yourself as such.
14.3 It is an offence under applicable law to misrepresent yourself as a private seller
when acting in the course of business.
14.4 We may remove adverts and take action where we reasonably believe a trader
